My tenant has abandoned my property but is still paying rent. He has taken a job as Landlord of a pub, I have proof. His wife is claiming benefits in her maiden name from the property [they married in the last 2 years] She is also living and working at the pub. I have issued new tenancy agreement but they obviously don’t go to the house to get the mail. I have asked to gain entry but they wont give me a date for access. So I want to issue a notice to quit as they haven’t signed the new agreement. If I hand deliver and they don’t get it due to not being at the property, do I still need a court order. They have also sub-letted the property in the past. I have checked the electoral roll and there are various people living there at different times, none of them known by me.

I need to sell the property due to ill health.
