A report has been released this morning across various news platforms such as Sky and BBC News that landlords who fail to evict illegal immigrants who do not have the right to rent and to live in England could be jailed for up to five years under new measures to be included in the Immigration Bill.
The announcement comes in response to the crisis in Calais, where thousands of illegal immigrants have gathered in an attempt to reach Britain. On Sunday, Britain pledged to pay for 200 extra private security guards, additional fences and more CCTV to boost security.
The Government says that it will make it easier for landlords to remove illegal immigrants whose visas expire and will also allow them to evict illegal immigrants without a court order.
Communities Secretary Greg Clark said: “the changes will crack down on rogue landlords who make money out of illegal immigration. In future, landlords will be required to ensure that the people they rent their properties to are legally entitled to be in the country, we will also require them to meet their basic responsibilities as landlords, cracking down on those who rent out dangerous, dirty and overcrowded properties."
Under the proposals, landlords will be required to carry out the ‘right to rent’ checks on each tenant’s immigration status BEFORE allowing them to move in to the property, the Home Office would then issue a notice when an asylum application fails or ends; which will trigger a power for landlords to end the tenancy, even without a court order in some circumstances.
Failing to do either of these will now be an offence, carrying a maximum penalties of five years imprisonment or a fine, which it turn will create a ‘blacklist’ of rogue landlords and letting agents who have been convicted of housing offences and ban them from renting out properties for repeat offenders.

“As a landlord I am baffled and disgusted why government think yet again decent people who have invested their money to offer others homes can be threatened with imprisonment for not being boarder agents and I am even more baffled that we have found the solution to this problem yet no one seems to want to promote it to landlords who do not know the cure
We as a company have made every effort to help landlords with the constant barrage of new legislation when all the national associations like the NLA and the RLA have not bothered to do a thing to help their paying members.
If government wants change, then they need to get off of the fence and promote the companies that can make it happen.”
