I am a tenant and I do not want my rent payments to go on my credit score. I pay my credit cards and bills every month and have a good credit rating which I try and keep like that.  I have had problems for 2 months now with my landlord who despite telling him about a blocked sink and other issues in my flat will not come out and repair them because he said there my fault so I have stopped paying him until he does. Why should he be allowed to add a problem with my rent because he wont fix the problems to my credit file it is no one else's business except mine and his and when he does the repairs I will pay him.

Matt I'm a tenant too (been one for over 20 years).
You can't just stop paying your rent because you've had a dispute with your landlord and the same for paying  credit card bills. You can't stop paying your credit cards just because they put the rate up!
There are set rules within any contract, even if you don't agree with them, you have signed it & not paying whilst in any contract is definitely not the way to do things.
Have you contacted your local council or citizens advice about your landlords negligence?

This is exactly why rent should be included on our credit scores and I think there are alot of tenants out there who would be very interested in this initiative.

Young lad to not pay your rent would be a foolish move and would not achieve anything positive in my view.

The previous poster Judy gives you sound advice.  You should take heed of it !!!

Matt,

The one certain thing that you must consider is paying your rent.

Landlords who do not look after their properties can be fined as a recent Oxford Landlord found out to his cost recently.  In the Landlord and Buy to Let Magazine there is a report of this Landlord who pleaded guilty to four offences of failing to comply for regulations for a house of multiple occupation.

The property had unmaintained fire escapes, unsafe carpet on a flight of stairs, inadequate light fittings and missing taps in the kitchen.

This sorry state of affairs cost the Landlord £8,630 and £630 in costs plus obviously the cost of the repairs.

There is one thing for certain – NOT all Landlords are like this.  But if you have doubts about your Landlord you should bring your Landlords alleged negligence to the appropriate people.

Well maybe good advise for him but I am not paying him and I will just move out and he can chase me for the money if he cant be bothered to do the repairs I cant be bothered to pay him tough luck should have done what I asked in the first place.

Is this the first time your sink has become blocked Matt? As I have many tenants that pour fat, oil and god knows what else down the sink/toilet and then they wonder why it repeatedly keeps getting blocked???!!!

I, personally, pay for the first unblock-age and then if it happens again I will fix it ASAP, but at a small service charge.

What are the other problems he is blaming you for?

Try the Mary Latham approach for your toilet and sink.

Fill the u trap with cola overnight and it might have cleared.

Are you abslutely sure that you have ONLY put normal waste and toilet paper down there?

Anything else could have caused the blockage.

If you want a good reference and believe you will need it; you should continue to pay your rent.

Put in writing the issues in the flat and give the LL a reasonable time to initiate works.

If he doesn't do the works then refer to the EHO for the toilet and the council housing dept for safety isssues.

Simple method to unblock sink is put a container underneath the sink u trap, unscrew the plastic nuts and flush u bend in sink clear making sure container is deep enough to take waste water whilst u bend is disconnected.

Refit and that might solve the problem.

It that doesn't work boil kettles and pour down sink and toilet.

If you have a mop put in toilet and plunge up and down and also for the sink.

Perhaps clear the sink first if you have to use the mop method before using in the toilet!!

If none of these work then you really do have larger issues which the LL must address.

If it is found that incorrect waste has ben put down sink and toilet then the costs are down to you.

Read your tenancy agreement and it will state something to that effect.

Do not sacrifice your good rental history for the sake of a blocked sink and toilet.

A blocked sink is something you should be sorting out yourself, it is part of behaving in a 'tenant like manner' and you will no doubt see that phrase somewhere in your tenancy agreement. There is case law precedent to indicate the sorts of things this covers, look up Warren v Keen( 1954 ).

You mention other issues but don't say what they are. If they are items the4 landlord is obliged to repair and he has refused you can get the repairs done yourself and withhold the cost of repairs from the rent and provide the landlord with the invoices for the work. Simply withholding rent will just end up with you being evicted and most likely a CCJ, not the best result I wouldn't have thought.

I love this type of post because it just gets us more members and then eventually you and those with your attitude will never get another rented property unless it is with a real bad Landlord or Agent that does not and wont network with their peers.

I have watched this thread whilst away on holiday and believe Matt is just ill informed about what he should be doing within his AST contract, but you know exactly what you are doing and that is why we as Landlords and Agents herein work together to keep you out of our property.

I hope that one day we will be able to make sure that tenants with this outlook will find the only home they can get is under the railway arches.

Please tell us more about how you hate landlords and why you should be allowed to do what you do without recourse as your comments just go to fuel your own long term demise

I am afraid screwyou; you are being somewhat naive.

You may well have just cause for feeling the way you do.

Have you been in communication with a EHO at the council enviroment section.

Damp is something that must be addressed otherwise the council will advise the property is uninhabitable until the damp has been addressed.

It is no good just complaining to the LL.

You need to write to him and cc the council and then follow up at the the council.

If you are having such issues that have not been resolved.

Give 1 months notice if  you are in a SPT and source another LL.

One presumes this LL is attempting to evict you.

So despite the possible efficacy of your complaint you may well struggle to source a tenant, especialy if the LL uses LRS.

It can't be that bad in this property if you still choose to live in it.

Your case could be more justified if you moved out.

Wow what a fantastic Idea both for Landlords and people like myself. In Sept 2009 I unfortunetaly had to go Bankrupt through no fault of my own, other than circumstance.

I had, and still have, a Professional job, and the decision to go Bankrupt was not taken lightly. I was informed, quite rightly at the time, that I would not get Credit (not that I ever want another Credit Card!!) for 6yrs.

I lost my lovely 2 bed flat, found myself stressed as I also have a Son to think of and to top it off my partner and I split up. Where would I go?? What would I do? I tried 2 or 3 'High St' Letting Agents to find a Property but due to only just becoming a Bankrupt they wouldn't touch me with a barge pole! I have a good wage coming in and despite me having more money in my pocket following Bancrupsy that I had when I was in Debt they would not allow me to Let a property from them due to this.

I then found a Landlord in the local paper and remember being upfront so I didn't waste either his or my time, and informed him I was a recent Bancrupt and would not have a problem paying. Thankfully this person had enough trust in me and I have been with the same Landlord for just over 2 yrs now.

I have a ZERO Credit Score and despite not missing a single payment in Rent, not even a 'late' payment, my Credit Score is still ZERO and will remain so for the next 2-3yrs.

Prior to Bancrupcy I had a Contract with Vodafone, and still do, but I want to come away from them and yet again I have never missed a Payment with them either but I can't as the next Phone Supplier checks my Credit Score and I get turned down so I have to stay where I am, at least for another 2-3yrs.

I cannot see why someone hasn't come up with a solution like this previously as I am sure I am not the 1st or indeed the last person who will go through this and despite up to date payments on Rent and Phone (the phone sounds like a small thing I know) but at least give us the recognition we deserve as there are, I am sure people out there who deserve to be 'Blacklisted' but not all of us and rate us on our Merits.

You are the whole reason that I wanted to do something like this, I truly think that people who have suffered at the hands of bad politicians policies should not continue to be penalised if they are trying to get themselves back on the right track financially.

We have to all start somewhere on a road to recovery and that can be with a good rent track record. 

Tell your landlord and/or Agent about us and get them to join and register you and we will get you out there as soon as we can sort out structure.

Good on you and your LL.  You're right, this is a great idea.  You're not the first and won't be the last person to go through bankruptcy as the first step to rebuilding their financial base after a crisis.  I'm a fair and responsible LL and I'm happy to let to any honest tenant who pays their rent and takes care of my property.  That includes two of my great current tenants who are both 'bankrupts'.  I let to them years ago knowing they were bankrupts and neither of them has ever missed a payment.  I wish I could put their 100% records out there for credit providers and other financial organisations to see – I might be able to if this initiative gets off the ground Laugh.  See my post on page 1 (post no. 15).
