Landlord and Tenant checking company breaches advertising rules
Tenant Referencing company Rentchecks.com has recently had a claim made against it regarding the breaching of advertising rules.
Rentchecks.com claimed on their website that they had been providing “pre tenancy & lease intelligence to landlord and agents for the past 10 years”. However a complainant reported the company to The Advertising Standards Authority (ASA) after seeing Companies House records showed the firm Rentchecks (Europe) Ltd had been incorporated in 2012.
Rentchecks.com defended the complaint, adding the limited company Rentchecks (Europe) Ltd supplied Rentchecks.com with IT capabilities, virtual contact services and temporary staff to assist with the vetting, but Rentchecks (Europe) Ltd had no legal connection to Rentchecks.com.
But the ASA upheld the complaint as they had not seen any evidence to support the claim “Rentchecks.com has been a leading provider of pre tenancy & lease intelligence to landlords and agents for the past 10 years”, therefore breaching CAP Code (Edition 12) rules 3.1 (Misleading advertising) and 3.7 (Substantiation).
Rentchecks.com has now been ordered to remove the claim in its current form and must also hold documentary evidence to support its existing/future claims.
